Section 9A of the Criminal Law (Sentencing) Act 1988 (SA) permits rectification where a sentencing judge had a settled intention as to the commencement date of a sentence but forgot to implement it when delivering sentence. The power is limited to correction of patent errors and does not extend to later reconsideration or second thoughts. Where offences are clearly unrelated, it is within the sentencing judge's discretion to make sentences cumulative.
