Differences in DNA likelihood ratios produced by different laboratories using different methodologies (different numbers of loci, amplification cycles, and software) do not of themselves impeach the reliability of any individual laboratory's results where the differences are explained by the different methodologies. The question whether a verdict is unreasonable by reference to the possibility of innocent secondary transfer of DNA, where the prosecution case depends substantially on DNA evidence, is a question of general importance to be determined by the Full Court. When assessing permission to appeal, the raising of a question of general importance may more readily lead to the grant of permission.
