The Court held that the right of peremptory challenge requires only a reasonable opportunity to view jurors' faces assessed objectively, and that alternative empanelment procedures (such as having jurors stand facing the dock) may satisfy this requirement; further, counsel cannot argue to the jury that intermediate facts must be proved beyond reasonable doubt following the enactment of ss 61 and 62 of the Jury Directions Act 2015.
