In partial acquisitions under the Land Acquisition and Compensation Act 1986 (Vic), the 'before and after' method in s 41(3) produces a single 'rolled up' market value figure assessed at the date of acquisition; it does not permit separate identification of an injurious affection component to which a different temporal perspective might apply. Post-acquisition events are irrelevant to the assessment of market value under s 41(3). The 10% solatium cap under s 44(1) is calculated by reference to market value as determined under s 41(3), not the market value of the acquired land alone.
