A diagnosis of ADHD, without rigorous evaluation establishing a causal connection between the condition and the offending conduct, is insufficient to engage Verdins principles 1 and 3 so as to reduce moral culpability or moderate general deterrence. Where the maximum penalty for a summary offence is a fine only, a sentence of imprisonment is invalid and must be set aside, but such an error does not necessarily infect the sentences imposed on related indictable offences.
