A mortgagor seeking a stay of a possession order in favour of a chattel mortgagee must ordinarily pay the outstanding mortgage debt into court, even where the mortgagor relies on a set-off and counterclaim alleging conspiracy or breach of s 111 of the PPSA. A proposal for staged payments over 30 to 60 days is insufficient to satisfy this requirement.
