A solicitor's equitable right over the fruits of litigation extends to permitting the solicitor to prosecute the taxation of costs in its own name where the former client's inaction creates a risk that the solicitor's entitlement will never be quantified. The right is not limited to cases of collusion between the client and judgment debtor. Under the Legal Profession Act 2004 (Vic), failure to comply with costs disclosure obligations does not extinguish the solicitor's right to costs; it merely delays the client's obligation to pay until costs are reviewed under Division 7.
