Where a possession charge and an importation charge involve drugs with materially different physical characteristics (particularly purity levels), the drugs will not be treated as the same for the purposes of the double punishment principle in Pearce v The Queen, and cumulation of sentences is permissible. The purity of drugs is a relevant distinguishing characteristic when determining whether drugs the subject of separate charges are the same drugs.
