A finding that a building practitioner is not a fit and proper person to practise does not necessarily mandate cancellation of registration under s 179 of the Building Act 1993 (Vic). The statutory discretion is broad, and suspension coupled with conditions governing return to practice may be appropriate where the decision-maker concludes that the practitioner may become fit in the future. A finding of present unfitness is not a finding of permanent unfitness.
