In historical sexual offence cases involving extreme delay, the cumulative effect of multiple sources of prejudice — including the death of key witnesses, unavailability of records, and demonstrated cognitive difficulties of the complainant — may render a fair trial impossible even where no single factor alone would warrant a stay. There is a practical limit to the number and effectiveness of forensic disadvantage directions that can be given to a jury.
