Where multiple rape convictions arise from a single incident of short duration, the totality principle may require greater concurrency than the statutory presumption of cumulation under s 6E of the Sentencing Act 1991 (Vic) would otherwise produce, even where the offender is designated a serious sexual offender. Individual sentences of 5 years' imprisonment for mid-range rape offending following a not guilty plea are within the permissible range.
