A sentencing judge who treats a breach of a Family Violence Intervention Order as an aggravating factor when sentencing for a substantive offence (such as aggravated burglary) committed in breach of that order cannot also impose a separate cumulative sentence for the FVIO breach, as this constitutes impermissible double punishment.
