An applicant for an examination order under ss 180, 180A and 180B of the Proceeds of Crime Act 2002 (Cth) must show adequate grounds and a legitimate forensic purpose, but the existence of multiple exclusion and compensation applications may itself disclose real questions about the source and ownership of restrained property. Where a proposed examinee's connection to the suspect is established, familial relationships between the suspect and other persons whose affairs are the subject of the proposed examination may provide a sufficient foundation for the order without the need for separate evidence connecting the examinee to each individual. Copies of the restraining order and exclusion/compensation applications should be tendered in evidence on such applications.
