Where an offender's traumatic brain injury or mental impairment is sustained after the commission of the offence, Verdins principles cannot be used to reduce moral culpability (principles one to four), though principles five and six (additionally burdensome imprisonment and risk of deterioration) may still apply but should attract only modest weight. Current sentencing practice for intentionally causing serious injury shows median sentences of four to six years, with the majority in the range of five to seven years.
