Complaint evidence under s 377(4) of the Criminal Procedure Act 2009 (Vic) may be admissible to support a complainant's credibility even where it lacks sufficient specificity to prove the fact asserted, provided it constitutes an identifiable, specific representation consistent with the complainant's account. Notions of innocent infection or contamination applicable to tendency and coincidence evidence are inapt when assessing the admissibility of traditional first complaint evidence under s 137 of the Evidence Act 2008 (Vic).
