An aggregate sentence of 7 years and 10 months' imprisonment for a course of conduct involving two prolonged high-speed police pursuits through heavy traffic, an armed threat with a samurai sword, and a home burglary does not infringe the first limb of the totality principle where the offender has a long record of similar offending, there is little or no mitigation, and the offender is at high risk of reoffending. Individual sentences of 3 years 6 months and 3 years 8 months for steal motor vehicle and drive recklessly offences of this seriousness are within the customary discretionary range. The s 9AA guilty plea discount is applied to individual sentences before totality adjustment, making it impossible to reverse-engineer a pre-discount aggregate.
