An accused person in criminal proceedings on indictment in Western Australia has no right of appeal against interlocutory orders, including refusal to adjourn a trial, prior to conviction. The Criminal Appeals Act 2004 (WA) covers the field and s 79(1)(b) of the District Court of Western Australia Act 1969 (WA) does not provide an alternative avenue. The appropriate remedy is to challenge any resulting unfairness on appeal against conviction under s 23 of the Criminal Appeals Act.
