The ACT Court of Appeal refused leave to appeal from an interlocutory decision of Mossop J concerning a stay of eviction proceedings, on two grounds: first, the applicant had already failed to obtain leave in a related matter (Halcombe v Hitchman [2018] ACTSC 56), which was a necessary precondition to success in this application; and second, the application was moot because the applicant had vacated the premises, rendering any stay of eviction of no practical value.
