Courts should be exceptionally reticent to interfere in legal practitioner disciplinary proceedings before the ACAT by way of judicial review of interlocutory rulings. The decision whether to entertain a no case submission in civil proceedings is a procedural matter for the tribunal, not an obligation. Ambiguity in the evidence adduced in support of a charge does not amount to latent duplicity rendering the charge bad. Legal practitioners subject to disciplinary proceedings have an obligation to provide reasonable assistance to the inquiry rather than adopting a confrontational approach.
