Where an appellate court allows an appeal and dismisses a statement of claim, it has power under s 75A(10) of the Supreme Court Act 1970 (NSW) to order the plaintiff to pay the first instance costs of a co-defendant who was properly joined as a respondent but did not itself appeal the costs order below.
