The power to turn out a person from licensed premises under Liquor Act 2007 (NSW), s 77(2)(a) does not require the authorised person to identify or hold a subjective belief as to the specific characteristic (intoxicated, violent, quarrelsome or disorderly) relied on; the objective existence of any one characteristic suffices, and a mistake as to the source of the power does not invalidate its exercise.
