Under s 39(3) and (4) of the Limitation Act 2005 (WA), a plaintiff need not prove the precise date of awareness of attributability; it suffices to establish that the extension sought does not exceed three years from when the plaintiff became or ought to have become aware, and this awareness may arise after proceedings have been commenced.
