A defendant who denies a plaintiff's claim bears no positive burden to adduce evidence to contradict the plaintiff's evidence; s 140 of the Evidence Act 1995 (NSW) does not require a defendant to provide 'clear or cogent or strict proof' to make out a denial, but rather the gravity of the matters alleged is relevant to whether the court is satisfied the plaintiff has proved the claim.
