The preconditions in ss 80 and 83(7) of the Children and Young Persons (Care and Protection) Act 1998 (NSW) regarding care plans and permanency planning apply only to 'final care orders' made on the Secretary's application for removal of a child, not to orders made on rescission or variation applications under s 90. Where a court in non-adversarial care proceedings departs from the basis on which parties have prepared their case, procedural fairness requires that parties be given the opportunity to adduce responsive evidence, including by adjournment if necessary.
