Where funds have been paid into court as security for a stay pending an appeal that has been concluded unsuccessfully, the court will not readily grant a further stay to enable a foreshadowed review under s 46(4) of the Supreme Court Act 1970 (NSW), particularly where there has been substantial delay and extensive prior litigation. The risk of insolvency in Security of Payment Act disputes lies upon the party obliged to make the progress payment.
