Neither the length of jury deliberation nor the trial judge's grant of bail pending appeal is an appropriate matter to take into account in determining whether a verdict is unreasonable. Where a jury direction was formulated by defence counsel and accepted without objection, leave under Criminal Appeal Rules r 4 is required and should ordinarily be refused. An apology in a recorded conversation may be treated by the jury as an acknowledgment of specific charged conduct where the context of the conversation identifies the conduct in question.
