Even modest co-operation (such as attending a single conference) is sufficient to exclude the mandatory operation of s 16AC(4)(a), but the court retains discretion under s 16AC(4)(b) to remove the entire discount for future assistance where the partial compliance was effectively worthless. The s 16AC jurisdiction is corrective, not punitive. Where Xiao error is identified but the sentence remains lenient having regard to all circumstances, no lesser sentence is warranted in law.
