A sentencing judge in NSW is not required to quantify the discount for quasi-custody or to backdate the commencement date of a sentence to reflect time spent in quasi-custody, provided the quasi-custody is taken into account in formulating the sentence. The manner in which quasi-custody is accommodated remains a matter for the sentencing judge's discretion. Where a sentencing judge expressly states that quasi-custody has been taken into account, no error is demonstrated merely because the judge did not backdate or quantify the allowance.
