A sentence of two years and eight months' imprisonment (before 25% guilty plea discount, approximately three years and seven months) for an aggravated (in company) break, enter and steal offence assessed as well below the middle of the range of objective seriousness is within the permissible range, particularly where the offender has a prior conviction for the same type of offence and guarded prospects of rehabilitation. The fact that stealing is the least serious of the serious indictable offences and being in company is the least serious aggravating circumstance does not of itself determine where the offence lies in the scale of gravity.
