An offer of compromise that invites total capitulation (dismissal plus payment of costs) does not contain a genuine element of compromise and will not engage the indemnity costs provisions under UCPR r 42.15A, unless the claim was recognisably hopeless at the time the offer was made. Even a relatively small monetary offer would suffice to demonstrate the requisite element of compromise.
