Section 185 of the Corporations Act 2001 (Cth) does not preclude the application by analogy of the six-year limitation period in s 1317K to equitable claims for compensation under the second limb of Barnes v Addy. The equitable doctrine of laches, informed by the analogous statutory time bar, operates independently of ss 180-184, and s 185 concerns only the effect of those sections. Practitioners cannot circumvent the s 1317K time bar by framing a claim as one for breach of equitable duties rather than statutory duties where the factual basis is the same.
