A sentencing judge's assessment of the risk of an offender committing further sexual offences must be founded on information logically capable of supporting an inference on the balance of probabilities; an assessment made without such a foundation constitutes specific error. Where a young offender has no rehabilitative progress, no family support, and escalating offending, a partly suspended sentence with no post-release supervision will be manifestly inadequate; a sentence with a parole eligibility date ensuring supervision is required.
