An applicant's personal disadvantages (Indigenous background, limited education, poor health) may explain delay in seeking to appeal, but the extension will still be refused where the proposed appeal lacks merit. Where the complainant's evidence is specific and consistent, maintained under cross-examination, and corroborated by complaint witnesses, and where defence counsel adequately cross-examined on the matters now relied upon, the proposed appeal will not be considered viable.
