Holders of rolling term leases for pastoral purposes under the Land Act 1994 (Qld) are not 'owners' for the purposes of the owner's consent requirement in s 263(1) of the Sustainable Planning Act 2009 (Qld). The 'owner' whose consent is required is the person principally entitled to receive the rent for the land — in the case of Crown leasehold land, the State. The two limbs of the definition of 'owner' in schedule 3 are strictly alternative. An equivalent provision appears in s 51(2) of the Planning Act 2016 (Qld).
