Where a notice of abandonment has been filed under r 69 of the Criminal Practice Rules 1999 (Qld), a subsequent application for extension of time is properly treated as an application to set aside the abandonment under r 69(4). Where there is no merit in the underlying appeal, the Court may deal with the matter on that basis in the interests of efficiency and finality without requiring a formal application to set aside the abandonment.
