A seller's warranty under cl 7.4(3)(a)(ii) of the standard REIQ contract that it is not aware of facts or circumstances that 'may lead to' the land being classified as contaminated land does not require the seller to assume that competent contractors engaged to demolish asbestos-containing buildings might carry out the work negligently so as to cause contamination. The phrase 'classified as contaminated land' in the warranty is to be read as referring to listing on the contaminated land register under the EPA. Post-contract contamination cannot be used as ex post facto justification for finding the seller was in breach of the warranty at the contract date.
