A water utility charge comprising a fixed amount entitling the consumer to a set volume of water, plus an excess charge per unit of water used over that volume, is a charge 'wholly according to the water used' under s 101(1)(a) of the Local Government Regulation 2012 (Qld). Non-adherence to the broadly stated local government principles in s 4(2)(a) of the Local Government Act 2009 (Qld) does not invalidate water utility charges otherwise levied in accordance with the regulations. The example in s 101(2)(b)(ii) is incompatible with the provision and should be ignored under s 14D(c) of the Acts Interpretation Act 1954 (Qld).
