A prior conviction for a violent offence, even one approximately 20 years old, may properly support the recording of a conviction for a subsequent offence of violence where the offences share common concerning features such as the offender acting as aggressor, punching victims in the face, and assaulting victims unable to protect themselves. The relevance of a prior conviction under s 9(10) is not confined to the bare fact that both offences involved violence. Section 12(6) (automatic recording on breach of community-based order) does not supply a positive ground for not recording a conviction.
