Where an offender pleads guilty to possessing items for use in connection with supplying a dangerous drug, a finding that the associated drug possession was for commercial purposes is inevitable. A sentencing judge may refer to subsequent offending to characterise the offender's drug problem without treating it as an aggravating factor. Where offences are committed on parole, s 160D of the Penalties and Sentences Act 1992 (Qld) operates to cancel parole automatically, precluding the setting of a parole release date and requiring instead a parole eligibility date.
