Where an applicant seeks to adduce expert evidence on appeal attributing reduced culpability to the combined effects of medical conditions and alcohol, the evidence must demonstrate that the applicant was unaware of alcohol's disinhibiting effects; otherwise, the evidence does not logically reduce culpability below what was known at sentence. Expert reports based solely on a review of medical records without interviewing or testing the subject may provide a merely speculative foundation for opinion.
