The unlawful sexual acts relied upon to prove a charge of maintaining an unlawful sexual relationship under s 229B of the Criminal Code (Qld) must have occurred during the period when the complainant was under the prescribed age; an act committed after the complainant reached the prescribed age cannot be used. A failure to give the s 21A(8) Evidence Act 1977 (Qld) warning about special witness arrangements is an irregularity but does not occasion a miscarriage of justice where the support person's presence in the courtroom was inconspicuous and incapable of giving rise to any inference adverse to the accused.
