An employer's duty of care to provide a safe system of work includes a duty to investigate and warn employees of local hazards of which the employer knows or should know and the employee may reasonably be unaware, even where the employee has statutory obligations for their own safety. Statutory obligations placed on employees (here, Civil Aviation Rules requiring pilots to maintain visual flight conditions) do not preclude an employer owing a duty to provide information that assists the employee in discharging those obligations. An entire agreement clause in an employment contract does not exclude a term implied by law that the employer will provide a safe system of work.
