A risk of general criminal offending or domestic violence, without more, is insufficient to establish an unacceptable risk of serious sexual offending under the Dangerous Prisoners (Sexual Offenders) Act 2003 (Qld). Where the identified sexual risk is based on extrapolation from general violent offending to potential sexual offending, and the respondent has no history of sexual violence against adult partners and no evidence of deviant sexual interests, the evidence may be insufficient to meet the high degree of probability standard required for a further supervision order. The absence of evidence-based research on the effect of supervision orders on recidivism risk is a gap in scientific knowledge that goes to the cogency of psychiatric evidence, not its admissibility.
