Mid-level commercial methylamphetamine trafficking involving quantities of approximately 164 grams sold and 84 grams possessed, with high purity and sophisticated methods, warrants a starting point of at least 8 years imprisonment under s 32(3) of the Controlled Substances Act 1984 (SA). Suspension of sentence is not available for such offending even where the offender is young, has good rehabilitation prospects, and has no significant prior criminal history. The serious repeat offender provisions under s 54 of the Sentencing Act 2017 (SA) apply where an offender has committed at least three serious drug offences, requiring a non-parole period of not less than four-fifths of the head sentence absent exceptional circumstances.
