Sentences for rape committed through coercion involving threats to distribute intimate images of a minor are not appropriate for suspension, even where the offender is young, has no prior convictions, and has intellectual difficulties. The strong message of deterrence where offenders exploit the vulnerability of immature complainants has less force if sentences for rape are suspended in the ordinary course. The 'serious repeat offender' provisions under s 52 of the Sentencing Act 2017 (SA) apply where an offender commits four separate offences each carrying a maximum penalty of at least 5 years imprisonment, requiring a non-parole period of at least four-fifths of the sentence.
