The prerequisites for the Board to direct suspension of a practising certificate under s 573(7) of the Legal Profession Act 2007 (Tas) are limited to specified jurisdictional facts: a complaint, valid appointment of an investigator, commencement of investigation, making of a requirement for production, service of notice, and non-compliance. There is no additional requirement that the Board be satisfied of risk to clients or the public, nor that the Board consider a practitioner's claimed reasonable excuse under s 586(3) before directing suspension. Section 586 is additional to and does not confine ss 572 and 573. A practitioner who refuses to comply with a s 572 notice cannot avoid the mandatory compliance obligation by asserting a reasonable excuse.
