A litigation funding agreement under which the judgment creditor is obliged to pay the judgment sum to a third party funder is analogous to removal of judgment proceeds from the jurisdiction, and constitutes a special circumstance justifying a stay of execution pending appeal. A conditional stay requiring payment into court may be appropriate in such circumstances.
