The instigator of group violence may properly receive a more severe sentence than co-offenders, and this differential does not constitute unjustified disparity. Remarks made by a sentencing judge during a plea hearing do not amount to sentencing findings where the judge's reasons for sentence express a different basis for the sentence imposed. A finding based on material in a report tendered by the applicant's own counsel does not give rise to a denial of procedural fairness.
