A second application for a stay will not succeed merely by tendering 'new evidence' unless the applicant satisfies the established three-part test for admission of fresh evidence, including demonstrating reasonable diligence. The decision of a single judge of appeal on a first stay application will not be revisited absent a proper basis for departing from that judge's reasoning and conclusions. A court may distinguish between refusing a general stay and granting a narrower injunction preventing disposal of a specific asset pending appeal.
