Defence counsel bear responsibility for developing Verdins submissions with specificity on the plea; the Court of Appeal will not entertain arguments on appeal that were not put to the sentencing judge. Following Gregory, past sentences for commercial quantity trafficking provide little guidance to future sentencing. The impossibility of achieving the intended criminal objective is unlikely to significantly mitigate an assessment of criminality in attempt cases.
